Informed consent enjoys an unassailable position in both clinical and research situations as a safeguard of patients’ rights. Keeping the patient involved in the decision making process is easier when there is direct communication with the individual. The Pakistani milieu offers challenges to this process because crucial decision making is often done by family members or is left entirely up to the attending physician. There seems to be a general acceptance of this shifting of focus from the individual to other (...) players. This also raises certain ethical dilemmas for physicians who may feel uncomfortable with communication which excludes the patient or in accepting a paternalistic primary decision making role. The objective of this informal qualitative study was to ascertain physicians’ perceptions regarding the process of information delivery to the patient in the Pakistani context and the various influences acting upon it. Despite the majority opinion of Muslim jurists that organ donation is permitted in Sharia, surveys indicate continuing resistance by lay Muslims, especially to donating organs following death. Pakistan, a country with 165 million Muslims, currently reliant on live donors, is considering steps to establish deceased donor programs which will require public acceptance and support. This article analyzes the results of in‐depth interviews with 105 members of the public focusing on opinions and knowledge about juristic rulings regarding kidney donations, donor‐family dynamics (...) in deceased donation decisions, and attitudes towards buying kidneys. The objective was to determine the influence if any of cultural and religious values, and norms of traditional family structures and kinships, on decisions to donate. Study participants view donation of kidneys, particularly from the deceased, through a different lens from that used by jurists and physicians, one that also does not conform to familiar paradigms defining ethical organ donation. A socially modulated understanding of Islam passed down the generations, and longstanding family‐centric norms, shape the moral worldview of many rather than academic juristic rulings or non‐contextual concepts of autonomy and rights. The results of this study also highlight that medical science may be universal but its application occurs within particularities of cultural and religious values, social constructs of the self and its relationship with others, and different ways in which humans comprehend illness, suffering, and death. These findings are of relevance both to transplant related professionals and bioethicists involved with this field. (shrink)

Contemporary bioethics has evolved over the past 40 years predominantly as a “Western” construct drawing fundamental inspiration for its conceptual and methodological frameworks from secular, Anglo-American philosophical traditions. American bioethicists can be credited with playing a defining role in the globalization of this new discipline to the developing countries of the world, but in this process, in the words of LaFleur, “Bioethics has become international without becoming internationalized.” Among the criticisms leveled against the dominant American model of bioethics is that (...) in its focus on universalism it ignores local cultural and religious influences that are vital to the comprehension of the moral life in many societies. Health research for progress in the control and conquest of disease afflicting man is unquestionable. Concerns arise when motives other than the advancement of scientific knowledge and benefit for individuals and society are the driving force behind clinical trials. These conflicts of interests become even more pronounced when dealing with populations rendered vulnerable by virtue of poverty and ignorance. South Asia with its teeming millions represents one such region. This essay examines the reasons that make this population vulnerable to exploitation. (...) Informed consent in the process of research is an area where such conflicts are prone to arise. In order to ensure that conflicting interests of researchers and funding agencies are kept in check, the processes of informed consent and ethical review of research need to be strengthened. Suggestions are put forward to modify the consent process to match the needs of South Asia and to strengthen the ethical review process for safeguarding the rights of the study subjects. But perhaps the most important safeguard against exploitation is the virtuous researcher himself with noble intentions. (shrink)

The Islamic Republic of Pakistan has a population of more than 145 million people, about 95% of whom are Muslims . Although it has a few large cities such as Karachi, almost 65% of the country is still rural, with a per capita income of $408 per year. The overall literacy rate is estimated to be 41.5% but is much lower for women in many of the provinces. Pakistan has a complex culture with many ethnic groups and socioeconomic strata, but (...) overall the society is characterized by hierarchical systems in both private and public domains. The population is religious and family centered with the “family” understood as extending beyond the nuclear; it is not uncommon to have three generations residing under one roof or within close proximity to each other and pooling their resources. In theory, a commercial market for kidneys could increase the scarce supply of transplantable organs and give impoverished people a new way to lift themselves out of poverty. In‐depth sociological work on those who opt to sell their kidneys reveals a different set of realities. Around the town of Sarghoda, Pakistan, the negative social and psychological ramifications of selling a kidney affect not only the vendors themselves, but also their families, communities, and even the country as a whole.

The wish to extend the human lifespan has a long tradition in many cultures. Optimistic views of the possibility of achieving this goal through the latest developments in medicine feature increasingly in serious scientific and philosophical discussion. The authors of this paper argue that research with the explicit aim of extending the human lifespan is both undesirable and morally unacceptable. They present three serious objections, relating to justice, the community and the meaning of life.

Since Aristotle and the Stoa, there has been a clash, worsened by modern predicate logic, between logically defined operator meanings and natural intuitions. Pragmatics has tried to neutralize the clash by an appeal to the Gricean conversational maxims. The present study argues that the pragmatic attempt has been unsuccessful. The “softness” of the Gricean explanation fails to do justice to the robustness of the intuitions concerned, leaving the relation between the principles evoked and the observed facts opaque. Moreover, there are (...) cases where the Gricean maxims fail to apply. A more adequate solution consists in the devising of a sound natural logic, part of the innate cognitive equipment of mankind. This account has proved successful in conjunction with a postulated cognitive mechanism in virtue of which the universe of discourse is stepwise and recursively restricted, so that the negation selects different complements according to the degree of restrictedness of Un. This mechanism explains not only the discrepancies between natural logical intuitions and known logical systems; it also accounts for certain systematic lexicalization gaps in the languages of the world. Finally, it is shown how stepwise restriction of Un produces the ontogenesis of natural predicate logic, while at the same time resolving the intuitive clashes with established logical systems that the Gricean maxims sought to explain. Falsafat wa-ḥayāt Abī Hāshim al-Jubbāʼī wa-madrasatuh -- al-Tawallud ʻinda al-Muʻtazilah.

The main purpose of this study was to examine the relationship between flow experience and goal orientation theory, as well as, the differences in flow experience based on the orthogonal model of goal orientation theory. Two hundred and seventy eight athletes completed the Task and Ego Orientation Sport Questionnaire based on how they usually feel. The Flow State Scale was completed thirty minutes after an important competition, along with the challenge-skill ratings, based on how athletes felt during the particular competition. (...) The results indicated that the athletes’ task orientation may be the critical factor for attaining flow in competitive sport, feeling more skillful and estimating the upcoming competition as challenging, while ego orientated athletes lack these elements, which are important for them to get into flow. Additionally, the balance between athletes’ goal orientation preferences seems important for the formation of flow experience. (shrink)

Dr Seuren's study deals with the problem of presenting an adequate model of grammatical description. The model he proposes conforms in its main outlines to the transformational generative grammar established by Chomsky, but differs in important respects. These mainly affect that part of Chomsky's syntactic component known as the 'base', which generates basic or 'deep' structures. In the model of the base proposed here two main constituents are distinguished for every deep structure representation of a sentence, vis-a-vis the operators and (...) the nucleus. The deep structure of a sentence is thus seen to be very similar to the logical structure of a proposition. The arguments given in support of this analysis are based on mainly on considerations of simplicity and semantic adequacy. (shrink)

SUMMARYThe present study paints the intellectual environment in which Ferdinand de Saussure developed his ideas about language and linguistics during the fin de siècle. It sketches his dissatisfaction with that environment to the extent that it touched on linguistics, and shows the new course he was trying to steer on the basis of ideas that seemed to open new and exciting perspectives, even though they were still vaguely defined. As Saussure himself was extremely reticent about his sources and intellectual pedigree, (...) his stance in the lively European cultural context in which he lived can only be established through textual critique and conjecture. On this basis, it is concluded that Saussure, though relatively uninformed about its historical roots, essentially aimed at integrating the rationalist tradition current in the sciences in his day into a new, ‘scientific’ general theory of language. In this, he was heavily indebted to a few predecessors, such as the French philosopher-psychologist Victor Egger, and particularly to the French psychologist, historian and philosopher Hippolyte Taine, who was a major cultural influence in nineteenth-century France, though now largely forgotten. The present study thus supports Hans Aarsleff's analysis, where, for the first time, Taine's influence is emphasised, and rejects John Joseph's contention that Taine had no influence and that, instead, Saussure was influenced mainly by the romanticist Adolphe Pictet. Saussure abhorred Pictet's method of etymologising, which predated the Young Grammarian school, central to Saussure's linguistic education. The issue has implications for the positioning of Saussure in the history of linguistics. Is he part of the non-analytical, romanticist and experience-based European strand of thought that is found in art and postmodernist philosophy and is sometimes called structuralism, or is he a representative of the short-lived European branch of specifically linguistic structuralism, which was rationalist in outlook, more science-oriented and more formalist, but lost out to American structuralism? The latter seems to be the case, though phenomenology, postmodernism and art have lately claimed Saussure as an icon. (shrink)

Nanotechnology presents significant challenges in terms of developing a regulatory framework. This is due to a lack of scientific knowledge about the behaviour of the technology in its interactions with biological and ecological processes, the environment and other technologies. Crucially, there is a great deal of uncertainty surrounding the potential environmental and human health and safety impacts of NT. Consequently, the development of NT is a potential test case for framing new models of ‘soft law’ voluntary governance as a substitute (...) for traditional command and control type regulation. Driven by ‘new science governance,’ an approach based on a combination of ideas in anticipatory ethics, future-oriented responsibility, upstream public engagement and deliberation and theories of justice may offer a solution. The uniqueness of the approach can be found in the incorporation of anticipatory approaches via public participation and deliberation as the input into procedural justice approaches with distributional justice as the output. The overarching objective of this work is to contribute to the discussion in relation to the internalisation of responsibility and the building of intellectual and societal capacity to anticipate negative consequences before they arise in the hope that such an approach could be the antithesis of the retrospective imposition of responsibility and liability after the harm is done, which is the outcome of traditional regulatory and ethical approaches. Taking the metaphor of Black CNN as a starting point, the project attempts to analyze the potential of the musical form of expression of hip hop as a communication structure of the black minority in the USA. After a historical-cultural explanation, which deals with the tradition of reflecting social and political aspects in the different musical expressions of the Black ethnic group in the USA, and which already shows the importance of this form of expression in the context of an (...) internal colonialsm, those socio-demographic developments are made comprehensible as a central point of criticism in the verbal articulations of hip hop. Against the theoretical background of cultural citizenship - a concept for determining cultural participation in the media society - 25 text samples found in hip hop releases from 1982 to 2004 will be examined for their correspondence with indicators that can be derived from political and social functions attributed to the media. The system of clinical ethics committees (CECs) in the United Kingdom is based on goodwill. No formal requirements exist as to constitution, membership, range of expertise or the status of their recommendations. Healthcare professionals are not obliged to use CECs where they exist, nor to follow any advice received. In addition, the make-up of CECs suggests that ethics itself may be under-represented. In most cases, there is one member with a training in ethics – the rest are healthcare professionals or (...) administrators, although a lawyer is generally also included in the membership. This begs the question as whether CECs can ‘do ethics’, as well whether or not they can take seriously the requirements of due process, formal justice and human rights. This study is aiming at analyzing extemporaneous methods of instructional speech in the context of the Naqshbandi Sufi Order and its parallels with improvised music as well as potential for modern educational purposes. Focusing on a processual analysis covering the flow of events in the communication and its environment, the work is using approaches applied in performance studies as well as improvised music, as well as cognitive science and psychological perspectives concerned with the mechanisms of the subconsciousness. Field research data (...) collected at the Naqshbandi lodge in Lefke/Cyprus as well as a considerable amount of recorded speech acts serve as material for the conducted qualitative content analysis. Without a doubt, as technology continues its ascent, society will be faced with new and altering values in an effort to catch-up with this extraordinary Digitization, adapt satisfactorily in order to utilize these strong developments in everyday life. Giorgio Agamben defines the sacred man or Homo Sacer as one who is not worthy of sacrifice. Having lost all rights, the person is reduced to the non-human. In modern times, banishment or banning by the law occurs when a state of exception is sanctioned by a totalitarian supremacy that suspends judicial power. The state of exception does not lie within or outside the boundaries of the judicial order, but in a zone of indifference. The state of exception in which (...) the norm is annulled represents the inclusion, which in turn captures the space in which law becomes suspended. Here, I discuss how the authorities in José Saramago's Blindness and The Cave function within the law of exception, confining and defining space, and ultimately marking the Homo Sacer. (shrink)
